In this guide
Is subletting legal in the Netherlands? Not for your whole home, and a room only if your contract allows it. According to Rijksoverheid, subletting your entire rented home is prohibited by law. A room in your home you may sublet, unless your rental contract forbids it; Het Juridisch Loket adds that you need your landlord’s permission for that. Getting it wrong can cost you your home.
This guide explains what is allowed, what is not, and what to consider if you need to be away or want to rent out a spare room. It sets out the rules as the government and municipalities publish them; it is not legal advice.
The broader Dutch housing crisis context helps explain why municipalities regulate this closely. If you are new to renting here, the Dutch rental contract rights guide covers your full set of tenant rights and obligations, and the rental scams guide is worth reading before you start any housing search.

The Core Rule: Whole Home No, a Room Only If Allowed
Rijksoverheid puts it plainly: “U mag niet uw gehele woning onderverhuren. Dat is wettelijk verboden. U mag als huurder wel een kamer van uw woning onderverhuren. Maar alleen als niet in het huurcontract staat dat u dat niet mag doen.” (rijksoverheid.nl, read 1 October 2026). The legal basis for the whole-home rule is article 7:244 of the Dutch Civil Code.
What that means in practice:
- Renting your entire flat to someone while you travel is subletting the whole home, which the law prohibits
- Renting a room to a lodger while you live there is allowed unless your contract forbids it; Het Juridisch Loket says you need the landlord’s permission
- Listing your home on Airbnb, Booking.com or any platform also falls under your municipality’s holiday-rental rules, and a private tenant needs the owner’s permission (see below)
- Letting someone live in your home in exchange for payment is subletting, whatever you call it
Ask your landlord in writing before you do anything, and keep the reply.
Social Housing vs Private Sector
Social Housing (Sociale Huur)
Housing associations (woningcorporaties) manage rent-controlled homes for people who meet income criteria. Their contracts and policies set the rules for subletting a room; the legal ban on subletting the whole home applies here too. Amsterdam states that a home owned by a housing association cannot be used for holiday rental at all (amsterdam.nl, read 1 October 2026).
Read the social housing guide for the full context, and ask your housing association about its own rules before you take in a room tenant.
Private Sector (Vrije Sector)
With a private landlord, the same legal rule applies to the whole home. For a room, it depends on your contract:
- Many contracts contain an explicit ban on subletting (onderhuurverbod); read yours carefully
- If the contract is silent, Rijksoverheid says you may sublet a room, but Het Juridisch Loket advises that you need the landlord’s permission, so ask anyway
- Landlords can agree to a room tenant with conditions (term, who the tenant is)
- The consequence of illegal subletting is civil: the landlord asks the court to end your contract, and you owe damages (Rijksoverheid)
Short-Term Rental (Airbnb): City-by-City Rules
Short-term rental to tourists through platforms like Airbnb and Booking.com is regulated by the municipality, on top of what your rental contract allows. The main cities publish their own rules. Below is what each city states on its own website (read 1 October 2026).
Amsterdam
| Rule | Amsterdam (2026) |
|---|---|
| Maximum nights per year | 30 nights per calendar year; 15 nights in parts of Centrum and De Pijp (Amsterdam says it wants to introduce the same limit in the Helmersbuurt from 1 January 2027) |
| Main residence requirement | Yes: you must live at the address and be registered there |
| Maximum guests | 4 people per stay |
| Registration number | Required; include it in every advertisement and listing |
| Reporting | Report every rental period before your guests arrive |
| Holiday rental permit | Required; costs €76, valid until 1 April of the following calendar year |
| Tourist tax | 12.5% of the overnight price (excluding VAT) |
Amsterdam also states that you cannot rent out a home owned by a housing association, that a private tenant needs the owner’s permission, that a VvE’s permission may be needed, and that nights already used by the previous resident in the same calendar year count towards your limit. You must pay tourist tax and income tax, meet fire-safety rules and avoid disturbing your neighbours (amsterdam.nl, read 1 October 2026). The city publishes a separate page on fines for breaking housing rules.
Note that holiday rental in Amsterdam means renting out your entire home while you are away. If you rent your Amsterdam flat, this does not sit easily with the legal ban on subletting the whole home: get your landlord’s written position first. With a cap of 30 (or 15) nights, the income is limited anyway.
Rotterdam
| Rule | Rotterdam (2026) |
|---|---|
| Maximum nights per year | 60 nights per calendar year |
| Main residence requirement | Yes: you rent out your own home |
| Registration number | Required |
| Reporting | Rented nights must be reported |
| Tourist tax | Logiesbelasting for every overnight stay: 6.5% of the bare overnight price excluding VAT |
Rotterdam also requires the home to be fire-safe and the rental not to cause nuisance to neighbours (rotterdam.nl, read 1 October 2026).
Utrecht
| Rule | Utrecht (2026) |
|---|---|
| Maximum nights per year | 60 nights per calendar year |
| Who may rent out | Only the owner or main tenant who lives at the address |
| Maximum guests | 6 (home up to 200 m²) or 8 (from 200 m²) |
| Registration number | Required since 1 July 2021 |
| Reporting | Report each rental in advance, since 1 July 2022 |
| Tourist tax | 8.5% of the overnight price, excluding VAT and breakfast |
Utrecht says the registration number does not in itself give you permission to rent out, and that it can fine landlords who break the rules (utrecht.nl, read 1 October 2026).
Den Haag
| Rule | Den Haag (2026) |
|---|---|
| Maximum nights per year | 30 nights per year |
| Main residence requirement | Yes: you live there and are registered in the BRP at that address |
| Permit and registration number | Both required; the permit is valid for 3 years |
| Reporting | Register each holiday rental in advance |
| Tourist tax | Yes |
The Hague says the permit costs €131.20, that the registration number and reporting are free, and that tenants should first check whether they may sublet; you often need your landlord’s permission (denhaag.nl, read 1 October 2026).
Other municipalities
Other municipalities set their own rules, or none. Check the website of your own gemeente before listing.
Important across all cities: these municipal rules apply whether you own or rent the property. For tenants, the rental contract and the legal ban on subletting the whole home come on top.
Going Abroad on Assignment: What Are the Options?
The legal ban on subletting the whole home matters most when you go abroad for a while. There is a second risk: according to Het Juridisch Loket, a subtenant of a whole home has tenant protection; if the main tenant gives notice and leaves, the subtenant becomes the new main tenant, “ook als de eigenaar of verhuurder van de woning geen toestemming gaf voor onderhuur”. The landlord can then ask the court within 6 months to end that contract, for example if the subtenant sublet with the intention of becoming the main tenant (juridischloket.nl, read 1 October 2026).
Some contracts for international tenants contain a clause that lets you end the lease early if your assignment changes. Such a clause is about ending the lease; it does not give you subletting rights.
Talking to your landlord: the right way
If you have a confirmed international assignment and want someone to live in your Dutch home while you are away:
- Review your contract: check for any subletting clause (onderhuurverbod) and any clause about temporary absence.
- Contact your landlord in writing: explain your situation clearly, the assignment period and your intention to return, and ask what the landlord will allow.
- Provide documentation: an assignment letter from your employer and the expected duration.
- Get advice before you sign anything with an occupant: Het Juridisch Loket (which gives personal legal advice to people with a low income and little savings) or your legal expenses insurer can explain the consequences for your specific case.
- Keep paying your rent: you remain responsible for rent, damage and compliance under your own contract.
If you are going abroad on a highly skilled migrant visa assignment or a work permit posting, ask your employer’s HR or relocation team whether they help with housing during the assignment.
Doing it anyway without asking risks the consequences described below.
If you are allowed to sublet a room, a Dutch rental platform is one way to find a room tenant. Kamernet lists rooms, studios and apartments (kamernet.nl, read 1 October 2026). See Kamernet →
Illegal Subletting: What Happens If You Are Caught
Rijksoverheid describes the consequences:
- Contract termination: the landlord ends your rental contract through the court, both when you sublet the whole home and when you sublet a room despite a ban in your contract.
- Damages: you must pay damages to the landlord.
- The subtenant may take over: if you sublet the whole home, the subtenant becomes the tenant; the landlord continues the contract you made with the subtenant (onderhuurderbescherming).
- Room tenants: if you sublet a room, the room tenant must leave when your own contract ends; room tenants have no subtenant protection. Het Juridisch Loket says the room tenant can then sometimes claim damages from you.
- The subtenant is not punishable: Rijksoverheid states that a subtenant is not punishable for illegal subletting.
Municipalities can fine breaches of their own holiday-rental rules on top of this; Utrecht, for example, says a fine can reach €40,000 depending on the breach (utrecht.nl, read 1 October 2026).
Renting Out a Room Legitimately
Room tenant while you live there
If your contract allows it and your landlord agrees, the agreement with your room tenant should specify:
- The start date and, if applicable, the end date
- The rent and what it includes (furniture, energy, internet)
- The deposit (for contracts from 1 July 2023 at most two months’ bare rent, Rijksoverheid)
- House rules
Contract length: since 1 July 2024 the Wet vaste huurcontracten applies, under which a new tenant gets a contract for an indefinite period; temporary contracts, lasting at most 2 years, are only allowed in specific situations, such as students renting temporarily for their studies in another municipality (rijksoverheid.nl, read 1 October 2026). Check which contract type applies before you draft one.
Tax and allowances: Rijksoverheid says renting out part of your rented home temporarily usually has no consequences for your income tax, as long as you receive a normal rent for that part (rent plus a fee for, for example, energy). If you receive huurtoeslag, your room tenant’s income does not count, but you must send the rental agreement to the Belastingdienst within 4 weeks (rijksoverheid.nl, read 1 October 2026).
Looking for a place yourself?
For expats who need housing for a few months while searching for permanent accommodation, rooms and apartments are listed on platforms such as HousingAnywhere and Kamernet. If someone offers you their whole rented home as a sublet, remember that this is prohibited by law for the main tenant. The HousingAnywhere vs Kamernet vs Funda comparison helps you choose a platform.
Anti-Kraak: What It Is and What to Expect
Anti-kraak (literally “anti-squatting”) is sometimes confused with subletting, but it is a different arrangement from subletting your own rented home.
Points to check in any anti-kraak agreement:
- What you pay each month and what it covers
- The notice period for leaving
- Whether you may have others live with you
- What rights you have compared with a normal rental contract
Anti-kraak does not give you subletting rights. Read the agreement carefully, and get advice (for example from Het Juridisch Loket) if anything is unclear.

Subletting a Room Step-by-Step
Step 1: Check your contract. Read your huurcontract carefully. Look for terms like “onderverhuur verboden”, “onderhuur niet toegestaan” or “geen toestemming voor onderverhuur.” If any of these appear, you may not sublet a room. If the contract is silent, ask your landlord for permission anyway.
Step 2: Write to your landlord. Send a written request (email is fine, but keep a copy). Include the reason, the proposed duration, the proposed rent and a brief description of the room tenant if you have one in mind. Frame it as a request, not a notification.
Step 3: Wait for written confirmation. Do not proceed until you have it in writing. If your landlord agrees verbally, confirm the terms by email and ask them to reply to confirm.
Step 4: Draft an agreement. Cover the duration, the rent, which utilities and services are included, the condition of the room, the deposit (at most two months’ bare rent for contracts from 1 July 2023) and how the agreement ends. Keep the Wet vaste huurcontracten in mind when you set the term.
Step 5: Document the handover. Do a documented check-in: photograph the room and shared spaces, note any existing damage, and both sign a condition report.
Step 6: Handle money carefully. Agree the rent in writing, record payments, and keep in mind that Rijksoverheid links the income-tax treatment to receiving a normal rent.
Step 7: Inform your insurer. Check whether your inboedelverzekering (contents insurance) covers a situation with a room tenant. Check with your insurer before handing over the keys.
Contents and liability insurance explained →
Step 8: Plan the end. A room tenant must leave when your own contract ends, and Het Juridisch Loket notes they can sometimes claim damages from you if they have to leave earlier than agreed. Agree in writing how either of you can end the arrangement, do a documented check-out and settle the deposit in writing.

Frequently Asked Questions
Is subletting legal in the Netherlands?
Not for your whole home. According to Rijksoverheid, subletting your entire rented home is prohibited by law. You may sublet a room of your home, but only if your rental contract does not forbid it; Het Juridisch Loket adds that renting out a room is not allowed without the landlord's permission. Illegal subletting can lead the landlord to end your contract through the court, and you then also owe the landlord damages (rijksoverheid.nl and juridischloket.nl, read 1 October 2026).
What are the Airbnb rules in Amsterdam?
According to the City of Amsterdam you need a registration number and a holiday rental permit (€76), you must live at the address and be registered there, and you must report every rental period before your guests arrive. You can normally rent out your home for up to 30 nights per calendar year, or 15 nights in parts of Centrum and De Pijp (Amsterdam says it wants to introduce the 15-night limit in the Helmersbuurt from 1 January 2027), to a maximum of 4 people per stay. A home owned by a housing association cannot be rented out, and a private tenant needs the owner's permission. You pay tourist tax (12.5% of the overnight price excluding VAT) and income tax (amsterdam.nl, read 1 October 2026).
What happens if I am caught subletting illegally in the Netherlands?
Rijksoverheid says the landlord ends your rental contract through the court if you sublet illegally, and you must also pay damages to the landlord. If you sublet your whole home, the subtenant can become the tenant: the landlord continues the contract with the subtenant, which is called subtenant protection (onderhuurderbescherming). A subtenant is not punishable for illegal subletting. Municipalities can also fine breaches of their holiday-rental rules.
Can I sublet my apartment while I am on assignment abroad?
Not the whole home: Rijksoverheid says subletting your entire rented home is prohibited by law, and Het Juridisch Loket notes that a subtenant of a whole home can become the main tenant if you give up the lease, even without the landlord's permission. Talk to your landlord in writing about what is possible, and get advice (for example from Het Juridisch Loket) before you agree anything with someone who would live there. You remain responsible under your own contract.
What is anti-kraak housing and is it subletting?
Anti-kraak (anti-squatting) is a different arrangement from subletting your own rented home, and it gives you no subletting rights. Read the terms of any anti-kraak agreement on notice period, costs and house rules carefully before you sign, and get advice (for example from Het Juridisch Loket) if anything is unclear.
Can I rent out a room in my apartment while I am still living there?
Rijksoverheid says a tenant may sublet a room of their home, but only if the rental contract does not say you may not; Het Juridisch Loket says it is not allowed without the landlord's permission. Ask your landlord in writing first. A room tenant has no subtenant protection and must leave when your own contract ends. If you receive huurtoeslag, the room tenant's income does not count, but you must send the rental agreement to the Belastingdienst within 4 weeks.
